Kingfisher Escape Competition 2024 (‘promotion’)
General

1. The Promoter is Bundaberg Media Pty Ltd (‘the promoter’) of 107 Targo Street, Bundaberg QLD 4670 ABN 83 643 012 579. Tel. No. 07 4167 0620.

2. Information on the Home Delivery Subscription Package, how to enter the Kingfisher Escape Competition 2024 (‘promotion’) and the prize form part of these Terms and Conditions.

3. Entry into the Competition is deemed acceptance of these Terms and Conditions and the Kingfisher Escape Competition rules.

4. Participants must agree to their information being shared with the Promoter for the purposes of promoting the competition and determining the outcome. If a participant does not wish for their information to be shared in this way, then they cannot enter the competition.

Who can participate
5. Participation in the Kingfisher Escape Competition is open to all Subscribers (‘participants’) excluding auto renewal customers, who purchase a Home Delivery Subscription Package to either Bundaberg Today, CQ Today or Gladstone Today between Monday February 05, 2024 at 08:30 AEST and Friday March 15, 2024 at 15:00pm AEST (‘promotional period’). Any participant can opt out of the competition component of the Home Delivery Subscription Package by contacting the Promoter in writing at the address shown at Clause 1.

6. Participants must be 18 years and over at the time of purchase of the Home Delivery Subscription Package to be eligible to enter; except employees of the promoter and their immediate family.

7. Immediate family includes the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.

8. The Promoter reserves the right to request the winner of the competition to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

11. To purchase a Home Delivery Subscription Package, participants must, during the promotional period, start, extend or renew a Home Delivery Subscription for either 13-weeks, 26-weeks or 52-weeks to either Bundaberg Today, CQ Today or Gladstone Today by phoning 1300 170 885, paying an invoice online, or paying in person at Bundaberg Today 107 Targo Street, Bundaberg QLD 4670 (phone 07 4167 0620) or CQ Today at 5-9 Hempenstall St, Kawana QLD 4701 (phone 07 4863 5050) during regular business hours.

How to Subscribe for a Home Delivery Package
12. Subscription bookings open Monday February 05, 2024 at 08:30 AEST and close on Friday March 15, 2024 at 15:00pm AEST(‘promotional period’).

13. Bookings received after the promotional period will be deemed invalid and will not be eligible to participate in the Kingfisher Escape Competition 2024.

How to Enter the Kingfisher Escape Competition

14. Participants who purchase a Home Delivery Subscription Package during the promotional period, will automatically receive a free entry to participate in the Kingfisher Escape Competition 2024.

15. The time of entry will in each case be the time the subscription payment is received by the Promoter and not the time the payment was submitted by the entrant.

16. The Promoter accepts no responsibility for any late, lost or misdirected entries including technical disruptions, network congestion or for any other reason.

17. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.

18. An entrant’s entry must not include:
(a) any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;

(b) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and

(c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these terms and conditions;

(d) The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

19. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.

20. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses or PO Box addresses.

Kingfisher Escape Competition 2024
21. The Kingfisher Escape Competition 2024 commences Monday February 05, 2024 at 08:30 AEST and concludes on Friday March 15, 2024 at 15:00pm AEST (‘promotional period’).

Cancellation
22. Participants who cancel their Home Delivery Subscription Package at any time throughout the promotion period and whether fully or partially paid, will no longer be eligible to continue to participate in the Kingfisher Escape Competition 2024.

23. The Promoter has the right to refuse any subscription booking.

Draw and Notification of winner
25. The winner will be the first valid entry submitted in accordance with these terms and conditions, that is drawn from all subscribers participating in the competition by random draw at Bundaberg Today, 107 Targo Street Bundaberg Qld 4670 on Friday March 22 at 15:00pm AEST.

26. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

27. The Promoter’s decision is final, and the Promoter will not enter in to correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.

28. The winner will be notified by telephone within two days of the draw.

29. The winner’s details will be published in Bundaberg Today on Friday March 29, 2024, Gladstone Today on Thursday March 28, 2024, CQ Today on Wednesday March 27, 2024 and Saturday March 30, 2024.

30. Prize will be awarded to the person named in the entry. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

31. Subject to State Regulation, an unclaimed prize draw will take place at Bundaberg Today, 107 Targo Stretet, Bundaberg QLD 4670 on Friday June 28, 2024 at 09:00am AEST. The winner of the unclaimed prize draw will be notified by telephone immediately after the draw. The winner’s details will be published in Bundaberg Today, CQ Today and Gladstone Today within 14 days of the redraw.

PRIZE
32. The winning participant will receive the following prize:

A holiday voucher for a trip to Kingfisher Bay Resort, K’gari. The value of the trip is up to $998 (incl. GST). The holiday voucher is valid for stay up until Friday October 25, 2024 and includes:
• 2 Nights in a King Hotel Room at Kingfisher Bay Resort for 2 adults
• Daily Breakfast in the Sand and Wood Restaurant for 2 adults
• Return Passenger ferry for 2 adults

33. Total Prize Pool up to $998 (incl. GST).

34. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

35. Independent financial advice should be sought as tax implications may arise because of accepting the prize.

36. Prizes cannot be transferred, exchanged or redeemed for cash.

37. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.

38. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

KINGFISHER ESCAPE TRIP – TERMS AND CONDITIONS
39. The Holiday Voucher is valid for stay up until 25 October 2024, subject to availability at the time of booking and cannot be taken during Australian school holiday periods, Australian public holidays or long weekends. Hotel accommodation upgrades are available at the winning participant’s own expense unless stated and subject to availability at time of booking. Additional voucher upgrades are available at the winning participant’s own expense unless stated above and subject to availability at time of booking. The Holiday Voucher is not valid with any other offer, is not transferable or redeemable for cash and must be taken intact. If lost or misplaced, vouchers will not be replaced. Inclusion(s) not utilised, is non-refundable. Monetary value of the inclusions cannot be used for any upgrades or in replacement of services not included in the voucher. The winning participant of the Holiday Voucher cannot on-sell or auction the prize for any monetary benefit. Kingfisher Bay Resort reserves the right to revoke the validity of the Holiday Voucher, if such an incident occurs. Any alterations to travel plans may incur a rebooking fee. Kingfisher Bay Resort may, without notice to the voucher-winner, substitute any services or the mode of carriage to carry the passenger. Food, beverages and incidental expenses will be at the expense of the winning participant unless otherwise stated.

40. The winning participant and their travel companion is responsible for all expenses over and above what is included in the prize, including but not limited to spending money, meals, drinks, laundry charges, activities, incidentals, gratuities, service charges, flights, travel (other than specified), parking, accommodation (other than specified), travel insurance, medical costs and all other ancillary costs.

41. It is the winning participant’s responsibility to take out, at their own cost, all relevant insurance (including but not limited to travel insurance) which may be required or prudent to be purchased.

42. The participant is responsible for ensuring that they and their travel companion are fit to travel.

43. By participating in the Kingfisher Escape Trip, the participant acknowledges and accepts that flying, driving, boating, travel and any other activities comprising the Kingfisher Escape Trip, may be inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.

44. All package travel will be subject to the carrier’s General Conditions of Carriage.

45. The participant and their travel companion must travel at the same time, must depart from the same ferry and are responsible for transport costs to and from their place of residence to Riverheads for ferry departure.

46. Frequent Flyer Points are not available.

47. Cancellation or change to itineraries may incur fees. Any fees or charges to cancel or change itineraries become the responsibility of the participant and their travel companion.

48. A credit card imprint or cash deposit may be required from the participant at check-in to the hotel for all incidental charges.

49. It is the winning participant’s personal responsibility to ensure that they have valid documentation, including but not limited to valid identification, which meets the requirements of Government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travelers.

50. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination of travel.

51. The Promoter is not responsible for any adverse conditions such as adverse weather conditions or industrial action or civil commotion, acts of terrorism or strikes that may occur whilst the participant and their travel companion is travelling.

52. It is the responsibility of the participant and their travel companion to enquire about local issues and conditions at destinations prior to travel.

53. The Promoter does not guarantee that the participant and their travel companion will enjoy the Trip or be suited to the type of Trip that is offered.

54. If the advertised prize becomes unavailable due to unforeseen circumstances, the Promoter reserves the right to provide the participant with a replacement prize of equal or higher value.

55. It is a condition of taking the Kingfisher Escape Trip that the participant and their travel companion must comply with all the conditions of use of the holiday and the supplier’s requirements. The trip must be taken as stated and no compensation will be payable if a participant is unable to use the trip as stated.

56. Any taxes or delivery costs which may be payable as a consequence of the participant purchasing this Promotional Package (other than specified) is the sole responsibility of that participant.

57. The prize must be taken by the person named on the Subscription as the participant in the competition. Any changes to this nomination will only be made subject to the Promoter being reimbursed for any costs related to the change.

58. Any winner must complete a Competition Release Form to confirm rightful collection of their prize once to confirm identity and residence as per the booking form.

59. The participant is responsible for all expenses over and above what is included in the prize.

60. If the voucher is lost, stolen or damaged, it cannot be replaced.

61. The voucher cannot be on-sold or used in the promotion of another promotion of any kind.

62. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

67. All entrants agree that they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.

Further Terms and Conditions
68. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this promotion if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the promotion. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this promotion.

69. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

70. If for any reason this promotion is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the promotion, subject to any direction given under State Regulation.

71. All entries must be sent or delivered to the addresses set out in these terms and conditions. Entries that contain any objects not specified in these term and conditions will be deemed invalid and will not be accepted. The Promoter and its agents take no responsibility whatsoever for such entries that do not comply with these terms and conditions.

72. Any entrant found to be using any form of software or third-party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

73. An entrant may not use a third party (including online promotion entry site) to enter on their behalf, except where the entrant needs to use those services of that third party to enter due to a disability. If the preceding sentence has been breached, the entrant will have all entries invalidated, any claim to any prize will be invalidated and where such an entrant has already been awarded a prize before being found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

74. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the recipient must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a recipient is unable to use the prize as stated.

75. The Promoter reserves the right to disqualify an entrant who claims to be a prize participant is unable to satisfy these terms and conditions.

Copyright, Statutory guarantees, Waiver and liability
76. In consideration for the Promoter awarding the prize to the participant, the participant hereby permits the participants submission, image and/or voice, as recorded, photographed or filmed during the participants participation in the prize to appear in connection with the Promoter publications or the advertising or marketing thereof, in any media whatsoever throughout the world and the recipient will not be entitled to any fee for such use.

77. The Promoter acknowledges that the entrant may own intellectual property rights (including copyright) in any material created or otherwise submitted to the Promoter in connection with the entrant’s entry or participation in any aspect of the promotion (Works). The entrant does not transfer their intellectual property rights to the Promoter by submitting an entry. The entrant hereby grants the Promoter a non-exclusive, irrevocable, perpetual, worldwide licence to use the Works (including modifying, adapting or publishing the Works, whether in original or modified form, in whole or in part or not at all, to use, modify, delete from, add to, publicly display and reproduce, the photo(s), including without limitation, in any online media formats and through any social media channels, pages or accounts) for the sole purpose of running the promotion, promoting and celebrating the promotion and future promotions and agrees that the Promoter may assign and/or sublicense the Works to third parties for this same purpose. Should the Promoter wish to use an entrant’s Works for any other purposes, it will contact the entrant to discuss licensing opportunities. The entrant acknowledges and agrees that neither the entrant nor any third party shall be entitled to any fee, royalty or other consideration in respect of such licence. If the entrant holds, now, or at any time in the future, any so called “droit moral” or moral rights in connection with the Works, the entrant unconditionally and irrevocably consents, for the benefit of the Promoter and all of its assignees, licensees and sub licensees to minor alterations to the Works which may be required for print or display purposes such as resizing and minor colour correction notwithstanding that such conduct may amount to derogatory treatment of the Works for the purposes of the Copyright Act 1968 (Cth) (Copyright Act). All Entrants consent to attribution by either full name or social media handle in satisfaction of their right to attribution under the Copyright Act.

78. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

79. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Promotion and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

80. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

81. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

82. All entries become the property of the Promoter. The Promoter collects personal information about you for the purposes of conducting this promotion. Any disclosure of such information will be made as required by law and in accordance with these terms and conditions, but no further use of this information will be made without prior consent.

83. The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services.We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection.
